At night my camera faces the street and when on 1080p the picture is grey but when I change it to 720p the picture is in colour, why is this?

Interesting and no real explanation. Sounds like it's very close to the threshold where the camera switches between color and B&W.

Is there anyway of turning the B & W off as I would prefer it not two switch to B&W but have the option to if needed?

No ..the B/W is auto switched base on light level
