Arlo Pro Battery Dead on Arrival

Today I received a Arlo Pro Camera pack (5 pack) via Amazon. The camera works whilst pluged in however refuses to charge. I have done some diagnostic with Arlo / Netgear over the phone and they agreed the battery is dead. I have been offered a replacement battery be sent out and got email to confirm this. Just now I received a second email however saying sorry there is no spare battery's available. We will notify you if this changes. No time frame, nothing just those two sentences.

Any suggestion - surely this can't be legal for a dead on arrival product.
